III. OLD BUSINESS
A. (Second Reading) An Ordinance Amending Chapter 223, Beach, of the Bethany Beach Town Code to Add a New Article VIII Relating to Restrictions on the Use of Shading Devices on the Beach (Hardiman)
This ordinance amends Chapter 223 by adding Article VIII relating to restrictions on the use of shading devices and other fixtures on the beach.
B. (Second Reading) An Ordinance to Amend Section 217 of the Bethany Beach Town Code to Clarify that Liquor Stores are Prohibited from Permitting On-Premises Consumption of Alcoholic Liquors (Killmer)
This ordinance amends Chapter 217 (Alcoholic Beverages) by inserting a definition of Liquor Store and by clarifying that liquor stores are prohibited to allow on-premises consumption of alcoholic liquor since it is not deemed to be a clearly integral and harmonious component of any use permitted in the Town of Bethany Beach.
IV. NEW BUSINESS
A. Discussion, Consideration, and Possible Vote on an Ordinance to Amend Chapter 425, Article VIII R-1A, Boardwalk Residential District, of the Bethany Beach Town Code (Killmer) (A Public Hearing regarding this Ordinance was Held on 1/19/2018)
This ordinance amends Section 425-49 of the Bethany Beach Town Code to allow all homeowners of the Seaside Villas to have the same rights and restrictions set forth in the Town of Bethany Beach Zoning Code. It was brought to the Council’s attention that some of the units within The Seaside Villas were in the R-1 District while others were in the R-1A District. The above amendments and additions were intended to provide that all unit owners within The Seaside Villas have the same rights and restrictions within the R-1A District.
B. Discussion, Consideration, and Possible Vote on an Ordinance to Amend the Official Zoning Map of the Town of Bethany Beach (Killmer) (A Public Hearing regarding this Ordinance was Held on 1/19/2018)
This ordinance amends the Zoning Map of the Town of Bethany Beach by rezoning Block 7, Lots 2-6, 97A Second Street, 97B Second Street, 97C Second Street, 97D Second Street, 97E Second Street and 97 F Second Street from R-1, Residential District to R-1A, Boardwalk Residential District. The purpose in making the amendment to the Official Zoning Map is to make sure all homeowners within The Seaside Villas have the same rights and restrictions pursuant to the Town of Bethany Beach Zoning Code.
C. Discussion, Consideration, and Possible Vote Regarding the Reconstruction of Cedarwood Street with Pervious Pavement and a Multi-Use Pathway, Connecting South Pennsylvania Avenue to the South Atlantic Streetscape Project (Graviet)
D. Appointment to Budget and Finance Committee (Gordon)
